PESA member meeting: changes in construction law – impact on Energy Storage

The ongoing work of the Government of the Republic of Poland on construction regulations, specifically:

  1. Adoption by the Council of Ministers of the draft Act amending the Construction Law and certain other acts (the “deregulation” draft);
  2. Consultations on the draft regulation of the Minister of Development and Technology on the technical conditions to be met by buildings and their location,

includes, among other things, provisions related to energy storage systems.

In this context, we would like to invite all PSME member companies to a meeting aimed at presenting the potential impact of the proposed changes on the energy storage industry.

Agenda:

  1. Draft Amendment to the Construction Law (UD22)
    • “Deregulation” in the Construction Law
    • Current legal status regarding building permits for energy storage systems
    • Proposed change – no permit required only up to a capacity of 20 kWh
    • Project status – after public consultations, before the parliamentary stage
    • Consequences of maintaining this provision – significant limitations on the development of small and medium-sized storage systems
    • Lack of public awareness of the topic during the consultation phase among industry organizations
  2. Draft Regulation of the Minister of Development and Technology on the technical conditions to be met by buildings and their location
    • Two chapters dedicated to PV installations and energy storage systems
    • Restrictive requirements for rooms with energy storage systems starting from 10 kWh capacity
    • Project status – before public consultation (30 days from publication on June 13)
