The Senate of the Republic of Poland is proceeding the law on emergency measures to cap electricity prices and support certain consumers in 2023 (parliamentary forms No. 2697, 2697-A and 2698, Senate form No. 846, 846A). This is a draft act submitted by the government as an urgent matter. The Minister for Climate and Environment has been authorised to present the government’s position during parliamentary proceedings. The Parliament passed the act at its 63rd sitting on 20 October 2022. It was referred to the Senate on 21 October 2022.
The drafting procedure did not include public consultation, however, the PESA actively participated in the legislative process to the extent prescribed by law. Understanding and supporting the purpose of the law, which is to mitigate the negative social and economic effects of electricity price increases on households, the micro, small and medium-sized enterprise sector and public utilities, as well as to reduce the risk of further electricity price increases, the PESA pointed out the provisions the adoption of which in the wording proposed in the draft could cause a number of serious negative effects impacting the energy security of our country and the level of energy prices in the medium and long term. We pointed out the possibilities of changing the provisions in such a way that the intended objectives of the law could be achieved without having [BOJR1] negative and long-term effects on the energy market and the economy in general. We presented our identified risks and proposed amendments to the provisions to the representatives of the Ministry of Climate and Environment, MPs and Senators. We sent letters outlining our position to professor Tomasz Grodzki, Speaker of the Senate of the Republic of Poland, and Mateusz Morawiecki, the Prime Minister.
